Ms Dijana Radulović, a judge of the Podgorica district court today displayed an utter lack of sensitivity for discrimination victims who try to obtain legal protection from discrimination.
Sudija Osnovnog suda u Podgorici gospođa Dijana Radulović danas je pokazala potpuni nesenzibilitet prema žrtavama koju su pred sudom zatražile zaštitu od diskriminacije.Ms Radulović’s handling of this case places the Montenegrin judiciary and the state of Montenegro on the list of countries where legal protection of basic human rights is denied, and where victims who denounce discriminatory practices before courts are made to suffer additional humiliation, insults and victimization.Mr Zdravko Cimbaljević’s, the executive director of NGO “LGBT Forum Progres“ arrived in court with a 2 (TWO) minute delay, which judge Radulović took as a sufficient enough reason to dismiss the discrimination case brought against university professor Slobodan Radonjić last May 2011.
The defendant Dr Radonjić in May 2011 made a series of statements and viewpoints subsequently published by the nation’s daily press and used to offend and humiliate Montenegrin citizens of gay and lesbian sexual orientation, making inappropriate and scientifically unfounded claims, calling gays and lesbians sick people, arguing that their rights (affirmation campaigns) should be curtailed and made illegal for the sake of the future of the nation’s children.
The plaintiff Mr Cimbaljević, who thus far remains the only gay man in Montenegro to have publicy come out, appeared at the hearing TWO minutes late for a legitimate reason, and judge Radulović would not lend an ear to Mr Cimbaljević’s explanation for such a brief delay, but instead went on to declare Mr Cimbaljević’s case as officially dropped. The hearing was to take place today April 4, 2012 at 1:15PM, while the official minutes of the court proceedings registered Mr Cimbaljević’s arrival at 1:17PM.
Cimbaljevic tried to explain the reason and he emphasized that he was late for only two minutes and he pleaded her to change her decision, upon which judge Radulovic answered that during those two minutes she managed to call out the name of Cimbaljevic for two times, and she even managed to make a record and state within it that because of his absence of only two minutes, she decided to consider the claim withdrawn.
The judge asked the consent of Dr. Radonjic, who was accused for discriminationto change the decision, which he refused to give for the understandable personal reasons. The court was dismissed and Cimbaljevic was appointed to the new claim. According to the law of discrimination, a new claim is only possible to file within the 90 days upon the act of discrimination.
The claimant Cimbaljevic and the LGBT forum Progress, as the only transparent LGBT group in Montenegro, cannot be responsible that the court of Montenegro do not consider cases of discrimination as priority, as they should, and take them into account only after ten months.
We were waiting for them for more than ten months and they cannot wait for our victims for only two minutes, even when the reason of the delay is conditioned by the situation we had in the LGBT Center, where we had to give a shelter for a high school student, who was subjected to physical and psychological violence from his family because of his sexual orientation.
During the trial, Cimbaljevic was not protected from the defendant and his audience, which were brought to humiliate and ridicule Cimbaljevic, so he was forced to take the copies of old Textbooks from which was previously thought in schools about homosexuality as a disease.
Such attitude of the judicial system further worsens the situation of the LGBT population in Montenegro, and considering the fact that they were deprived of the judicial protection, their life in Montenegro becomes extremely uncertain and unbearable. The procedure of Judge Mrs. Radulovic only shows that all the training carried out and the big amount of wasted budget money was without concrete results and without any sense.
